What Happens When Your Spouse Doesn’t Give You a Chance to Speak, Even at Your Trial?

ControllingSpouse

Being married to someone who never lets you get a word in edgewise is exhausting.  If you make it past your tenth wedding anniversary with a relentless chatterbox, you either have copious patience, selective hearing, or both.  Your spouse tells pointless anecdotes when she is happy and launches into prolonged diatribes when she is upset.  Trying to discuss important matters with your spouse is a losing battle, because your spouse is so adept at the art of the filibuster that you do not get to give your perspective, because it is already time for work, or you can’t stay awake any longer.  Eventually, you file for divorce in an attempt to get some peace and quiet, but you are not out of the woods yet.  The pendency of your divorce tends to amplify your spouse’s flaws.  A cheapskate spouse only becomes cheaper after you file for divorce, and a splurge-happy spouse only becomes more prodigal.  Thus, you should not expect your blabbermouth spouse to suddenly turn taciturn simply because you have filed for divorce.  You should, however, contact a Boca Raton divorce lawyer.

The Case of the Motor Mouth Husband

A Palm Beach County couple filed for divorce in 2010.  The court decision does not go into detail about the factors that led to the breakdown of the marriage, but based on the husband’s behavior at the divorce trial, which the court decision does describe, one can imagine why the marriage ultimately failed.  The husband represented himself in court, and the only witness he summoned was his wife.  Acting as his own attorney, the husband questioned the wife for upwards of four hours.  Many of the questions were about minute details that had no direct connection to the issues raised in the divorce petition and the response.  The judge reminded the husband of this fact multiple times during the wife’s long stint on the witness stand.

By the time the wife’s lawyer had a chance to begin making his arguments, only 15 minutes remained of the time the court had scheduled for the trial.  The wife’s lawyer mentioned that there would not be enough time for him to make his arguments and examine his witnesses.  Eventually, the court declared a mistrial and scheduled a new trial.

A Divorce Lawyer Can Help You Make Sense of Chaos

If, throughout your marriage, your spouse acted like the world revolved around him, and things only got worse after you filed for divorce, this will be obvious to the judge.  Your lawyer can communicate calmly and keep your divorce case on track, even if your spouse has been derailing your plans for years.
